1. Who operates EverAlive
EverAlive is a platform operated in good faith by a collaboration of private individuals holding Italian and Venezuelan nationality. The site is provided "as is" to help families and loved ones preserve the memory of deceased persons.
We are not a funeral home, cemetery, or funeral services company. We are a digital space to honour memory.
2. Who can use the service
To create an account and publish content you must be at least 18 years old. Minors may browse the site and leave memories on public memorials with the consent of their guardian.
You commit to using the service respectfully: no impersonation, defamation, offensive, sexual, violent content, or content that violates third-party rights.
3. Content you publish
You keep ownership of the content you upload (photos, biographies, memories, messages). By publishing it, you grant us a limited, free, and non-exclusive licence to store, display, and process it to operate the service.
You warrant that you have the necessary rights to upload each photo, text, or video. If you publish third-party material without authorisation, you are solely responsible.
If content infringes third-party rights, violates the content policy, or is inappropriate, we may hide or remove it without prior notice.
4. Memorials and data of deceased persons
Memorials are created to honour the memory of deceased persons. The creator declares, under their own responsibility, to have an affective bond and knowledge of the passing.
If a direct relative of the deceased requests removal or transfer of the memorial, we will process the request after verifying identity. See takedown policy.
We are not responsible for the accuracy of biographical information or funeral service data published by users.
5. Memorial visibility
Each memorial can be set to public (search-engine indexable), unlisted (link-access only), or private (invited collaborators only). You choose the level.
Private memorials never appear in public search engines or sitemap. Unauthorised access returns a 404 (we do not confirm the existence of the memorial).
6. Service modifications
EverAlive may modify the service, add or remove features, suspend accounts that violate these terms, or interrupt the service at any time.
We try to notify in advance if changes affect your memorials (via email to the owning user).
7. Limitation of liability
EverAlive is provided "as is", without express or implied warranties. We are not liable for data loss, service interruptions, or user-published content.
To the extent permitted by law, our liability is limited to the amount paid for the service (which in most cases is zero, since EverAlive is free for individuals).
8. Jurisdiction and applicable law
These terms are governed by Italian law, as one of the operators resides in Italy (EU member state). In practice, this grants you the protection of the General Data Protection Regulation (GDPR) and European consumer rights.
If you reside in the European Union, GDPR rights apply and prevail over any contrary clause. You may file complaints with the data protection authority of your country of residence (in Italy, the Garante per la Protezione dei Dati Personali).
If you reside in Venezuela or another Latin American country, local data protection laws apply. In case of dispute, we will try to resolve it in good faith before resorting to judicial means.
